Surcharges
Due to increased security measures, a number of carriers have introduced additional surcharges to cover costs. On average, the charges appear to range from $0.15/kg, CAD
minimum $5.00 CAD for air movements, $300.00 and $600.00 US for 20' and 40' containers respectively, and $15.00 US per cubic meter or per metric ton for less than container load.

We recommend that exporters contact their carrier(s) of choice in order to determine whether or not additional surcharges may apply.
Canadian Dairy Farmers Celebrate WTO (short lived?) Victory


The appellate body of the World Trade Organization (WTO) ruled in favour of Canadian dairy farmers that there is no evidence that Canada's artificially high domestic prices do not constitute an unfair export subsidy.

The decision does not rule out appeals as the Appellate Bodyconcluded that it was "unable
to complete the analysis of theclaims made by New Zealand and the United States under Articles 9.1(c) or 10.0 of the Agreement on Agriculture,.."

At issue is Canada's supplymanagement system, whereby provincial marketing boards setquotas that are key in determining domestic prices, while export prices are based on private contracts between farmers and food processors.

New Rules for Split Shipments in the U.S.

U.S. Customs has proposed alternatives for the accounting of split shipments. Currently, importers are required to submit a single entry to cover any goods arriving on one conveyance and consigned to a single consignee

Under the proposed regulations the following guidelines would apply:

  • shipments must be delivered and accepted intact by carriers on a single bill of lading or waybill
  • split by the carrier, acting completely on its own
  • have no change in consignee
  • may be accounted for under a single entry provided the split portions arrive directly from abroad through the same port of entry in the United States within ten calendar days of the date the first portion arrived.
In addition, importers would have the option of having the goods released as they arrive or wait until the entire shipment turns up. Or importers may continue to file separate entries for each portion of the shipment as it arrives.
Customs maintains the right to examine individual shipments, whether split or not, for examination.

A notice was published in the Canada Gazette, Part 1, Vol. 135, No.51 dated December 22, 2001,proposing new Natural Health Products Regulations.

China Joins the World Trade Organization

On November 10, 2001, the WTO announced that China will become a member of the WTO thirty days after the WTO receives notification that China's Parliament has ratified the agreement. This after almost fifteen years of negotiations with China.

In becoming the 143rd member, China agreed to carry out a number of commitments to liberalize trade and provide a more predictable environment for both trade and foreign investment under the WTO rules.

Our eyes were glued to the news as the events of September 11th unfolded and throughout our company, we heard employee after employee ask, "What can I do to help?" The company responded quickly, getting a Red Cross USA Relief campaign underway. Employees were encouraged to donate either via cheque or payroll deduction, with the pledges being matched by Russell A. Farrow Limited. Not only did employees pledge money to this worthwhile cause, but the Trade Compliance Staff in Ayr organized a luncheon. When all was said and done, our employee and corporate donations topped $13,000!
