Administrative Monetary Penalties (AMPs) to Increase as of April 1, 2019

The Auditor General of Canada criticized the CBSA’s Administrative Monetary Penalties (AMPs) for being too low to improve compliance with trade programs in his 2017 Audit of Customs Duties.

As a result of this, effective April 1, 2019, the CBSA will increase a number of AMPs related to commercial trade. Increases will bring penalty levels in line with other non-trade commercial penalties. These increases affect non-compliant importers only.

This announcement shows an increased focus on compliance by the CBSA that importers need to be aware of. Importers need to understand their obligations and make sure they have a compliance program in place.
